Predmet Ugovora
1.1. Predmet ovog Ugovora je regulisanje svih
međusobnih prava i obaveza nastalih po
osnovu otvaranja, vođenja i gašenja
dinarskih i deviznih računa Klijentanerezidenata kod Banke;
Article 1
Subject of Agreement
1.1 The subject of this Agreement is regulation
of all mutual rights and obligations arising
from opening, maintaining and closing of
the foreign currency (FCY) and Dinar (RSD)
accounts of the Client-nonresidents with the
Bank;
1.2. Ugovorne strane saglasno utvrđuju da Banka
ovim Ugovorom preuzima obavezu da
Klijentu, na njegov zahtev i u njegovo ime,
otvori i vodi sledeće tekuće račune:

1.3. Ugovorne strane su se sporazumele da
Banka, na zahtev Klijenta, otvori Klijentu i
druge Dinarske račune i Devizne račune za
posebne namene, čije je otvaranje i vođenje
propisano zakonom, propisom ili aktom
nadležnog organa:

Obligations of the Bank
2.1. Banka ovim Ugovorom preuzima obavezu 2.1 The Bank hereby undertakes to:

deviznom tržištu, a u skladu sa
propisima;

može izvršiti nalog za plaćanje ili uplatu
po svojoj proceni, postupajući sa

c). Klijentu redovno stavlja na raspolaganje
izveštaje o dnevnim promenama na
Računu zajedno sa stanjem Računa na
dan izvršenih promena, i to narednog
dana, a najkasnije 2 (dva) radna dana
nakon izvršene promene na Računu i/ili
ispostavljenog naloga, u formi izvoda koji
Klijent preuzima ili koji mu se stavlja na
raspolaganje na način naznačen u
pisanom zahtevu za otvaranje Računa
i/ili dodatnim zahtevom Klijenta;

f). poštuje princip tajnosti Računa u skladu
sa Zakonom i da informacije o računu
daje samo Klijentu ili po nalogu suda,
odnosno drugog nadležnog organa.
Član 3.
Obaveze Klijenta
3.1. Klijent ovim Ugovorom preuzima obavezu
da:

Article 3
Obligations of the Client
3.1 The Client hereby undertakes:

Član 4.
Izvršenje naloga
3.2 The Client may authorize one or several
persons to dispose with funds on the
Account with precisely defined limitations, if
any.
3.3 The enclosure of signatures of persons
authorized to handle the Account shall be
done exclusively in the premises of the
Bank. The specimen of signatures shall be
kept in the Bank, therewith the deposited
signatures of authorized persons shall be
valid until their revocation, in written form
acceptable for the Bank.
Article 4
5
Execution of orders
4.1. Banka ovim preuzima obavezu da izvršava
instrukcije Klijenta za plaćanje na teret
Računa, ali samo do iznosa raspoloživih
sredstava na Računu, i to po redosledu u
skladu sa instrukcijama klijenta na označeni
datum valute. U slučaju kada, iznos
raspoloživih sredstava na Računu nije
dovoljan u cilju izvršenja instrukcije Klijenta,
Banka će odmah obavestitit Klijenta o tome I
zahtevati dalje instrukcije.
4.1. The Bank hereby undertakes to execute the
Client's payment instructions debiting the
Account, but only up to the amounts
available on the Account. In case that there
are no sufficient funds on the Account for the
execution of the concrete instructions of the
Client, the Bank shall immediately inform the
Client about that.
4.2. Knjiženje uplata na račun Klijenta načinjena
greškom ili omaškom službenika Banke ili
usled neke druge greške na strani Banke
mogu biti poništena prostim unosom ispravke
greške i bez posebnog naloga odnosne
stranke.
4.2. Any entries credited to the Client’s account
by error or omission of the Bank’s officers or
due to any other error made by the Bank
may be reversed by a simple entry adjusting
such error with no special order given by the
respective party.
4.3. Banka će nalog kojim se vrši plaćanje prema
inostranstvu u slučajevima u kojima je Klijent
nije obavezan da dostavi dokumentaciju
kojom dokazuje obavezu i osnov plaćanja,
primiti ili ga vratiti Klijentu, najkasnije
narednog dana od kada je podnet.
4.3. The Bank shall receive or return the
payment order to the Client, at the latest
following day after the date of receipt, if the
Client makes international payments in
cases in which Client does not have an
obligation to submit the Bank the

Član 5.
Kamata, Provizija, Naknada i sl.
Article 5
Interest, Commission, Compensation and
etc.
5.1. Na sredstva koja se nalaze na Računu
Banka će obračunavati i plaćati kamatu u
valuti u kojoj je račun otvoren, u skladu sa
svojom važećom poslovnom politikom,
umanjen za iznos pripadajućih poreza.
5.2. Klijent se obavezuje da Banci plaća, na
ime naknade za usluge obavljanja platnog
prometa za račun Klijenta, provizije i
naknade u skladu sa važećom poslovnom
politikom Banke.
5.3. Klijent se obavezuje da plaća Banci
provizije i naknade u skladu sa Tarifnikom
o pružanju usluga koji Klijent i Banka
potpisuju. U cilju efikasnije realizacije svoje
predmetne
obaveze

ovim
Ugovorom, neopozivo i bezuslovno,

osnovu ugovora koji su ili će biti zaključeni
sa Bankom i to za iznos glavnice, kamate,
provizija i troškova.
5.5. Banka je ovlašćena da automatski zaduži
bilo koji Račun Klijenta koji je predmet
ovog Ugovora ili bilo koji drugi račun
Klijenta kod Banke. Za obračun će biti
primenjen važeći srednji kurs Narodne
Banke Srbije na dan zaduženja računa.
Član 6.
Trajanje i Prestanak ovog Ugovora
6.1. Ovaj Ugovor stupa na snagu danom
potpisivanja od strane ovlašćenih lica obe
ugovorne strane.
6.2. Ovaj Ugovor se zaključuje na neodređeno
vreme.

5.5 the Bank is authorized to automatically
debit any Account subject to this

the Bank. Applicable middle exchange rate
of the National Bank of Serbia on account
debit day shall be applied.
Article 6
Validity and Termination of this Agreement
6.1 This Agreement shall become effective on
its signing date by the Parties official
representatives.
6.2 This Agreement is concluded for an
indefinite term.
6.3. Klijent je saglasan da Banka, osim u
slučajevima predviđenim zakonom može,
na osnovu svoje diskrecione odluke, u
slučajevima kada Klijent ne koristi Račun u
skladu sa ovim Ugovorom kao i kada u
periodu od 6 (šest) meseci uzastopno na
Računu nema sredstava, ili na računu
nema promena u smislu uplata i/ili isplata
sa Računa, da jednostrano otkaže ovaj
ugovor i po isteku otkaznog roka od 15
(petnaest) dana ugasi-zatvori Račune
Klijenta.
6.3 Client agrees that the Bank, except in the
cases stipulated by Law may, according to
its discretionary decision, in the cases
when the Client is not using the Account
according to this Agreement, as well as in
the cases when in period up to 6 (six)
consecutive months has no changes on the
Account, inflows and/or outflows, has the
right to unilaterally cancel this Agreement
after of 15 (fifteen) days notice period and
close Client’ s Accounts;
6.4. Ugovorne strane se saglašavaju da će se
na sve što nije regulisano ovim Ugovorom
primenjivati odredbe važećih zakonskih
propisa kao i Opšti uslovi poslovanja
UniCredit Bank Srbija a.d., sa kojima je
Klijent upoznat pre potpisivanja istog i koje
prihvata. U slučaju nesaglasnosti između
odredaba Opštih uslova poslovanja i

Ugovora, prednost će imati odredbe i uslovi
izneti u ovom Ugovoru.
6.5. Osim razloga za prestanak ovog Ugovora
predviđenih relevantnim propisima, svaka
Ugovorna strana može jednostrano
raskinuti ovaj Ugovor, dostavljanjem drugoj
strani pisanog obaveštenja/zahteva za
gašenje u tom smislu, uz ostavljanje
otkaznog roka od 15 (petnaest) dana koji
počinje da teče od dana prijema pisanog
obaveštenja drugoj ugovornoj strani o
otkazu ovog Ugovora. Za vreme otkaznog
roka, Klijent je dužan da izmiri sva dospela
dugovanja prema Banci. Ukoliko Klijent u
otkaznom roku ne izmiri svoja dospela
dugovanja prema Banci, Ugovor ostaje na
snazi i nakon isteka otkaznog roka.
6.6. Banka gasi Račune i bez zahteva Klijenta
za gašenje ako Klijent prestane da postoji
kao pravni subjekt, saglasno relevantnim
propisima.
6.7. U slučaju gašenja Računa, Banka će
sredstva sa ugašenih računa preneti na
račun Klijenta naveden u zahtevu za
gašenje Računa ili na račun pravnog
sledbenika, a ukoliko pravni sledbenik nije
određen - na račun sredstava Banke koja
se ne koriste, odnosno na račun/e u skladu
sa zakonskim propisima.
6.8. Klijent je izričito saglasan u skladu sa
članom 47. stav 3. Zakona o bankama, da
Banka ima pravo da podatke iz ovog
Ugovora, podatke o Klijentu, njegovim
povezanim licima, dokumentaciju koja čini
dosije uz ovaj Ugovor, kao i druge podatke
koji se smatraju bankarskom tajnom, te
podatke o obavezama po ovom Ugovoru i
načinu njihovog izmirivanja i pridržavanju
ugovornih odredbi, prosledi u Centalnu
bazu podataka UniCredit grupe, članovima
UniCredit grupe, članovima svojih organa,
svojim akcionarima, zaposlenima u Banci,
spoljnom revizoru Banke, NBS, drugim
licima koji zbog prirode posla koji obavljaju
moraju imati pristup takvim podacima, kao i
trećim licima sa kojima Banka ima
Agreement. If there is any conflict between
GBC and the Agreement, the terms and
conditions of the Agreement shall prevail.
6.5 Except for the reasons for termination of
the Agreement determined by relevant
regulations, each Party may unilaterally
terminate this Agreement by sending an
information in writing/Request on Account
closing to the other Party to that effect,
with a period of notice of 15 (fifteen) days
following the day of delivery of such written
notice to the other Party. During the
termination period the Client will be obliged
to settle any and all matured obligations
towards the Bank. If the Client fails to fulfill
its matured obligations towards the Bank
within the termination period, the validity of
this Agreement shall be extended after
expiry of the termination period.
6.6 The Bank will close Account without the
Clients request if the Client ceases to exist
as a legal entity, in accordance with the
applicable regulation.
6.7 In case of Account closing, the Bank shall
transfer the funds from the closed Accounts
to the account of the Client indicated on the
account closure request or, to the account
of its legal successor, but if the legal
successor is not determined to the account
of non utilized funds, or onto the
appropriate account/s in accordance with
regulations.
6.8 The Client is expressly agreed in
accordance with Article 47 Paragraph 3
Bank Law, the Bank has the right to make
available information under this Agreement,
information about the Client, its related
entities, the documentation that makes file
with this Agreement, and other information
considered bank secrecy and data on
obligations under this Agreement and the
manner of settling and adherence to the
contractual provisions, to the central
database of UniCredit Group, the members
of UniCredit Group, the members of its
bodies, its shareholders, bank employees,
external auditor of the Bank, NBS, other

sa poverljivim podacima. Klijent je izričito
saglasan da Banka ima pravo da podatke o
Klijentu koji se odnose na adresu, brojeve
telefona, faks i telefaks uređaje, e-mail
adrese i ostale podatke za uspostavljanje
kontakta, a koje je Klijent prezentovao
Banci prilikom potpisivanja ovog Ugovora,
koristi
radi
dostavljanja
Klijentu
obaveštenja
o
svojim
aktivnostima,
proizvodima i uslugama, u vidu letaka,
prospekata, elektronskih poruka, kao i svih
drugih sredstava poslovne komunikacije i
poslovne prezentacije.
6.9. Ugovorne strane saglasno utvrđuju da će
eventualne nesporazume koji mogu
proizaći u vezi sa realizacijom ovog
Ugovora rešavati na miran način, a ukoliko
to nije moguće iste će izneti na rešavanje
pred nadležan Privredni sud u Beogradu.
6.10. Eventualna šteta koju ugovorne strane

Ugovora i vršenju platnog prometa,
rešavaće se saglasno odredbama važećih
propisa.
6.11. Ovaj Ugovor je sačinjen u 3 (tri)
istovetna primerka od kojih 2 (dva) za
Banku i 1 (jedan) za Klijenta, na srpskom i
engleskom jeziku a u slučaju neslaganja,
važeće su odredbe teksta na srpskom
jeziku.

information. Client expressly agrees that
the Bank is entitled to information about the
Client relating to the address, phone
numbers, fax, and fax machines, e-mail
addresses and other data for the contact,
and that the client has presented to the
Bank during the signing of this Agreement,
the benefits to deliver to the Client
information about its activities, products
and services in the form of leaflets,
brochures, emails, and all other means of
business communication and presentation
6.9 The Parties are mutually agree that any
misunderstandings that may arise in
connection with the realization of this
Agreement will be solved in a friendly
manner, and if that is not possible they will
submit it for settlement before the
Commercial Court in Belgrade.
6.10 Any damage that a party may cause to the
other party in the performance of this
Agreement and payment transaction, shall
be dealt in accordance with provisions of
the Laws.
6.11 This Agreement is made in 3 (three)
identical copies out of which 2 (two) for the
Bank, and 1 (one) for the Client, in Serbian
and English language, and in case of
discrepancy, Serbian text shall prevail.
